Ripple Says XRP Can Withstand a CLARITY Act Defeat

XRP’s legal position may actually hold down the fortress, proving more resilient than much of the broader crypto market even if the U.S. Senate failed to advance the CLARITY Act in September.

Ripple CEO Brad Garlinghouse has argued that the token’s future does not depend on a single piece of legislation, pointing instead to the company’s completed court battle with the Securities and Exchange Commission.

The comments come as industry focus shifts to a September 15 procedural vote on the market-structure bill.

Coinbase CEO Brian Armstrong has described the vote as the most important near-term step toward durable U.S. crypto policy, while acknowledging it will require significant bipartisan support to clear the Senate.

XRP Holds Court Clarity, Not Congressional Cover

Ripple’s position rests on the judicial outcome of its lengthy SEC case, which delivered a degree of legal clarity that many other digital assets still lack. Garlinghouse noted that this certainty has helped attract more developers and commercial activity into the XRP ecosystem.

A court ruling, however, is not the same as federal legislation. The CLARITY Act aims to create a clearer national framework for determining when digital assets fall under securities or commodities rules.

Without it, companies outside XRP’s specific legal situation could continue facing uncertainty around registration, trading, and product development.

That distinction is super relevant for XRP holders. A failed bill would not automatically reverse Ripple’s legal outcome, but it could leave the wider U.S. market operating under fragmented rules and ongoing regulatory risk.

The Vote Carries Broader Crypto Market Weight

Armstrong has framed passage of the bill as an opportunity to lock in recent policy progress for years to come, arguing that a stable framework would allow crypto firms to compete more effectively with traditional financial institutions.

The proposal has encountered disagreements over stablecoin yields, ethics provisions, and anti-money-laundering requirements, leaving its path uncertain.

Prediction markets assign low odds to a successful September vote, highlighting the political risk still surrounding the legislation. XRP has recently traded near the $1 level, while investment products linked to the token recorded $253.6 million in inflows during the second quarter.

Brad Garlinghouse’s wider message is that blockchain adoption will continue regardless of Washington’s timeline. The outcome still carries weight: XRP may enjoy a legal head start, but a clear national framework could shape how quickly institutions, exchanges, and developers expand across the rest of the U.S. crypto market.
